1. Who you're contracting with

WebLynx (weblynx.online) is a product of ProLinx Media (“ProLinx Media”, “we”, “us”, “our”). By creating an account or using WebLynx, you enter into a binding agreement with ProLinx Media on these Terms & Conditions.

2. Acceptance

By accessing or using WebLynx you confirm that you have read, understood, and agreed to these terms. If you do not agree, you must not use the service. If you are using WebLynx on behalf of an organisation, you confirm you have authority to bind that organisation.

3. The service

WebLynx lets you generate, configure, and publish marketing websites (“Sites”). We grant you a limited, non-exclusive, non-transferable right to use WebLynx within the plan you have subscribed to.

4. Acceptable use

You agree not to:

  • Use WebLynx for unlawful, fraudulent, or harmful purposes;
  • Send spam, unsolicited communications, or malware;
  • Infringe anyone's intellectual property, privacy, or other rights;
  • Interfere with the security of the service, including by probing, scanning, scraping, or attempting to bypass technical limits;
  • Reverse engineer, resell, or redistribute the service except as expressly permitted.

5. Your account and content

You are responsible for keeping your account credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date. You retain ownership of content you upload, and grant us a limited licence to host and process it solely to provide the service.

6. Intellectual property

ProLinx Media retains all rights, title, and interest in WebLynx and its underlying software, documentation, branding, and templates. No rights are granted other than the limited use rights set out in these terms.

7. Payment, subscriptions, and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service enquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms and our Refund Policy.

8. Service level

We work hard to keep WebLynx available and performant, but we do not guarantee that the service will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Suspension and termination

We may suspend or terminate your access if you materially breach these terms, fail to pay fees, pose a security or fraud risk, or repeatedly or seriously violate our policies. On termination, your right to use the service ends and we may delete your data after a reasonable export window.

10. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or related to these terms is limited to the fees you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, consequential, special, or punitive damages, including loss of profits, revenue, data, or goodwill. Nothing in these terms limits liability for fraud, death, or personal injury where such limitation is prohibited by law.

11. Indemnity

You agree to indemnify ProLinx Media against claims arising from your content, your use of the service in breach of these terms, or your unlawful conduct.

12. Changes

We may update these terms from time to time. Material changes will be communicated through the service or by email. Continued use after changes take effect constitutes acceptance.

13. Governing law

These terms are governed by the laws of the Republic of South Africa, and disputes will be subject to the exclusive jurisdiction of its courts, unless mandatory local law provides otherwise.
